Sick Leave Entitlements


The Holidays (Increasing Sick Leave) Amendment Act 2021 has been in place since 24th July, 2021.

This Act increased entitlements from 5 days per annum after the first 6 months employment to 10 days per annum.

Reminders for Employers:

  • Update your staff about the changes if you haven’t already
  • Make sure that your employees get 10 days entitlement from their next entitlement after 24th July 2021.  There is no change to current entitlements
  • Check staff who had a sick leave anniversary date in July 2021 as to what entitlement was added.  We have had an enquiry where the payroll system had given 10 days to an employee whose entitlement date fell before 24th July, 2021
  • Update your sick leave and medical certificate clauses in your employment agreement templates or contact a member of the team at Grow HR who can help with this.

If you are agreeing sick leave in advance of entitlement remember to agree in writing that it is an advance of entitlement and what the arrangements would be if they left employment before they were entitled to sick leave.
